FONE BAZAR LIMITED is a company incorporated under the Companies Act 2006 as a private company limited by shares. The registered office is in England and Wales. Given at Companies House, Cardiff, on 1st January 2023.

Product & Sales Related:

FoneBazar.com is a specialized retailer in mobile phone technology. The following terms and conditions act as a legal agreement between us, specifying the conditions for the sale of products to our customers. All purchases made through FoneBazar.com must comply with these terms and conditions. Any product purchase not aligned with these terms will be explicitly identified and explained.

Use of Products & Contract:

The use of products purchased from FoneBazar.com and any related contracts will be subject to English law. In case of any dispute between FoneBazar.com and customers, we recommend an out-of-court settlement for resolution. Products available for purchase on FoneBazar.com are not considered everyday commodities. If a customer declares the capacity to contract, they are bound by these terms and conditions without the protection of any by-laws.

Customer Acceptance:

By submitting an order, the customer automatically accepts these terms and conditions. Written agreement signed by both parties is required to alter these terms. Our online terms and conditions are subject to change at any time, and it is advisable for customers to review them with each purchase. Consequently, all orders are governed by the current online terms and conditions.

Product Description & Costs:

FoneBazar.com strives to provide clear and accurate information about the products available online:

  • Prices are displayed in UK Pounds (£), excluding shipping fees.
  • Product availability and pricing may change based on discounts and offers.
  • We ensure that all prices listed online are free of typographical errors.

Delivery Charges & VAT:

Delivery of products purchased from FoneBazar.com is free. If a customer needs to return a FAULTY product within 14 days from the purchase date, the return will also include free delivery. FoneBazar.com employs the Margin Scheme for VAT on second-hand items, making it ineligible for VAT claims by customers or businesses. The Margin Scheme allows us to charge VAT only on the profit portion of each item, not the entire sale value.

For businesses requiring a VAT invoice for second-hand items, the full VAT amount will be charged on top of the displayed price. Please contact us via email to arrange the purchase.

For brand-new items, VAT is charged as standard, and a VAT invoice will be provided.

Incorrect/Wrong Order Received:

If a customer receives a different product than what was ordered on our website, FoneBazar.com must be notified within 28 days of receiving the item via email at fonebazarUK@gmail.com. Failure to notify us within this timeframe will result in a restocking fee of 15% of the original order value.

Order Placement & Confirmation:

For online mobile phone purchases, FoneBazar.com requires completion of an online registration form, which includes name, phone number, and payment details. FoneBazar.com is not responsible for emails sent to the wrong address or parcels delivered to an incorrect address due to customer-entered information errors. An automated order confirmation email is sent to the customer after making a purchase, which allows tracking of the product until it is dispatched.

Cancellation of Orders:

Customers can cancel an order made through FoneBazar.com via email or phone. Once an order has progressed for dispatch, it cannot be canceled. In such cases, the customer must wait to receive the product and utilize the product warranty as needed.

Product Availability & Grading:

Products are available online while stocks last, and featured prices are offered. Customers seeking more information can contact FoneBazar.com via email or phone. The actual condition of products is always described in the product details. If the product condition does not match the description, customers can contact FoneBazar.com for resolution.

Payment, Invoicing & Receipts:

All payments for products are accepted after the order is completed. Payment methods include:

  • Visa/MasterCard/Maestro/American Express (All transactions handled by PaymentSense).
  • Paypal (All transactions handled by PayPal).

FoneBazar.com does not store customer financial details. Information is collected lawfully and in compliance with the Data Protection Act 1998. Customers have the right, upon request and providing proof of identity, to access and correct any inaccurate information. Order information entered by the customer during a purchase is not considered an invoice. After an online purchase, customers receive a confirmation email with a warranty form.

Packaging, Confirmation & Delivery of Products:

All purchases made through FoneBazar.com are packaged and dispatched securely. Upon making an online order, customers receive a confirmation email with details about the product purchased. FoneBazar.com is committed to delivering products on or before the date specified in the confirmation email, excluding bank and national holidays. Products are sent to the address provided by the customer.

Delivery Conditions:

  1. Customer Unavailability: If a customer is unavailable at the delivery location, they will receive a delivery card. They can confirm an alternative delivery date by calling.

  2. Delay in Delivery: Each product purchased from FoneBazar.com comes with a specified delivery date. If a customer does not receive the product by the indicated date, they can submit a complaint to FoneBazar.com for resolution.

  3. Loss of Product Parcel: If a parcel has not been received or is lost, customers have 10 working days to declare the loss. FoneBazar.com will make an attempt to redeliver the product if a loss is reported within the specified time frame.

  4. Confirmation of Receipt: When products are delivered, an acknowledgement is required in the form of the customer's signature.

  5. Mistaken Invoice for Product: Any customer mistake in an online purchase must be reported to FoneBazar.com via email or phone within the specified time frame.

Warranty of Products & Return Policy:

Items can be returned within 14 days of the dispatch date. For warranty claims, products can be returned for repair at any time within the warranty coverage. To return a product to FoneBazar.com, customers must use a recorded delivery method and provide proof of postage. An item is considered as the entire unit of the received order, and incomplete items will be returned to the customer.

When returning an item, customers should use an appropriate box and provide adequate shockproof material to protect the product during shipping. If a product is found to be faulty, it can be repaired or exchanged under warranty coverage. Customers are responsible for backing up their data before returning a phone, removing the SIM card, memory card, and covers, as FoneBazar.com does not take responsibility for any data loss or damage.

Return/Exchange of Products:

Upon purchasing a product, it will be delivered to the specified address, and the warranty will be as mentioned in the product description. If a customer experiences technical problems with a product, the warranty covers internal, technical issues. Physical damage to the product after receipt is not covered by the warranty. Items to be returned must be in saleable condition and should be returned with all accessories, including data cables and warranty forms. Failure to meet these conditions may result in the item being returned to the customer at their expense.

Process of Returned Products:

Depending on availability, returned items can be exchanged or refunded. If the item cannot be replaced, FoneBazar.com will issue a full refund to the customer. The return process will be initiated upon receipt of the returned product.

Disputed Charges:

Any disputes raised by customers regarding payment or services will be carefully handled in coordination with the involved parties. Before escalating a dispute, customers are encouraged to contact our team to resolve the matter without resorting to a dispute. Disputes will be managed by our payment/dispute team, which will work closely with payment providers to provide accurate information. Customers are advised that fraudulent disputes may be reported to third-party agencies.

Jurisdiction/Liability:

This agreement is governed by English law, and both the customer and FoneBazar.com submit to the non-exclusive jurisdiction of the English courts.

Matters Beyond Our Control:

FoneBazar.com will not be held liable for the inability to provide services due to factors beyond our reasonable control, such as technical failures, natural disasters, government actions, or industrial disputes.

Sharing of User Information:

When user information is shared with FoneBazar.com or its subsidiaries, it may be used to obtain or provide supplementary information and services, including purchase feedback, revenue protection, and assistance with delivery. User information will not be sold or misused. By using the FoneBazar.com website or its subsidiaries, customers agree to this data sharing.

Severability:

If any of the terms and conditions are deemed unenforceable in a court of law, the relevant section will be removed from the terms of sale, and the integrity of the remaining terms will be upheld.

PayPal Buyer Protection:

If an eligible item bought online does not arrive or does not match the seller's description, PayPal's Buyer Protection will reimburse the customer for the full amount of the item, including postage and packaging costs. Buyer Protection covers all online purchases when using PayPal. Items not covered include real estate, motorized vehicles, custom-made items, industrial machinery, prepaid cards, in-person purchases, or money transfers to friends or family.

FoneBazar.com Money Back Guarantee:

If a customer does not receive a product dispatched by FoneBazar within the specified time frame (typically 7-10 working days), FoneBazar will either replace the product or offer a full refund. In case the item is not as described, the customer can return the item within 14 working days from the purchase date for a full refund, including postage costs.
